Partners and notional rent

- Q: One of the partners at the practice owns the premises and receives the notional rent. He feels that all the partners should pay equally for the building's upkeep and maintenance. I understood that GP landlords receiving notional rent should bear responsibility for all external repairs, decoration and insurances, while the tenants, including non-property owning partners and the landlord, are responsible for internal repair and decoration. Is this correct?

Rent for ex-partner

- Q: I am a GP who has recently left a post of senior partner at a practice. The practice property was owned in equal proportion by the three partners. Since I left I have not received any payment for my share of the property. The remaining two partners are trying to secure a loan on the property in order to pay me. Am I entitled to a share of the notional rent until such time as I am paid for my share in the property?

VAT on premises

- Q: We have a rent and repairing lease for which the PCT reimburses us at 107.5%. The 7.5% is the rent and repairing element. The PCT told us it calculates the 7.5% on the rent before, rather than after VAT. Is this correct according to the NHS (General Medical Services - Premises Costs) (England) Directions 2004? Should the PCT also reimburse water rates and landlord's buildings insurance?
