Foreign doctors working in this country should be held to account under UK law for any mistakes they make, says the GP whose father was killed by German doctor Daniel Ubani.

West Midlands GP Dr Stuart Gray's father David died last year when Dr Ubani accidentally gave him an overdose of diamorphine. Dr Ubani has been struck off by the GMC, but continues to practise in Germany after receiving a nine-month suspended jail term there.

Dr Gray told GP: 'Dr Ubani came in, did a shift, killed my father and has gone back to Germany. He is not accountable to UK law. I think doctors should be accountable in the country they work in, and once a restriction is placed on their practice, that should apply across the EU.

'I can't see how you can commit a negligent act in one country and continue to work in another.'

Dr Gray added that Dr Ubani had had a 'few hours' of induction, and that was not enough to work in UK general practice.

He said that doctors who do not work as GPs in their own country should not be able to work as one here - Dr Ubani works primarily as a cosmetic surgeon in Germany.

The fact that Dr Ubani did not face trial in the UK also denied Dr Gray's family the chance to have any input.

'My dad's partner would have been able to say what happened, and have some input into the case if it had taken place in the UK,' said Dr Gray.

He added: 'The GMC does not know how many foreign doctors are practising in this country.'

The family is seeking an independent review of the incident, which has led to calls for a review of out-of-hours care across the UK.
